NOTICE AND AGENDA OF REGULAR CITY COUNCIL MEETING CITY OF BALCH SPRINGS, TEXAS AUGUST 10, 2026 6:30 PM CITY HALL 13503 ALEXANDER ROAD BALCH SPRINGS, TEXAS, 75181 NOTICE IS HEREBY GIVEN THAT THE CITY COUNCIL OF THE CITY OF BALCH SPRINGS, TEXAS WILL HOLD A REGULAR MEETING AT THE ABOVE NAMED DATE, TIME AND LOCATION. PURSUANT TO SECTION 551.127 OF THE TEXAS GOVERNMENT CODE, FOR THIS MEETING AT THE STATED LOCATION, A QUORUM OF THE CITY COUNCIL WILL BE PHYSICALLY PRESENT, AND THIS NOTICE SPECIFIES THE INTENT TO HAVE A QUORUM PRESENT THERE. THE MEMBER OF THE CITY COUNCIL PRESIDING OVER THE MEETING WILL BE PHYSICALLY PRESENT AT THE ABOVE LOCATION. ONE OR MORE MEMBERS OF THE CITY COUNCIL MAY PARTICIPATE IN THIS MEETING REMOTELY, AND IF SO, VIDEOCONFERENCE EQUIPMENT PROVIDING TWO-WAY AUDIO AND VIDEO DISPLAY AND COMMUNICATION WITH EACH MEMBER WHO IS PARTICIPATING BY VIDEOCONFERENCE CALL WILL BE MADE AVAILABLE. PRESENTATIONS 1. Presentation by Teresa Jackson, with Sharing Life Community Outreach, to update on the status of the Balch Springs Pantry. ITEM OF COMMUNITY INTEREST 1. Pursuant to Texas Government Code Section 551. 0415 the City Council may report on the following items: (1) expression of thanks, congratulations or condolences; (2) information about holiday schedules; (3) recognition of individuals; (4) reminders about upcoming City Council events; (5) information about community events; and (6) announcements involving imminent threat to public health and safety. PUBLIC COMMENTS PUBLIC COMMENT GUIDELINES This portion of the agenda is the public's opportunity to address the Council about any item listed on the agenda, except public hearings. Comments related to public hearings will be heard when the specific hearing begins. Public comments are limited to three (3) minutes per speaker, unless otherwise required by law. Per the Texas Open Meetings Act, the Council is not permitted to take action on or discuss any item not listed on the agenda. Items suggested for action may be placed on a future agenda, at the Council's sole discretion. Under Sec. 22.01 of the Texas Penal Code, it is a felony of the third degree for a person to intentionally, knowingly or recklessly cause bodily injury to a public servant who is lawfully discharging an official duty, or to do so in retaliation or on account of an exercise of official power or performance of an official duty as public servant. Further, attendees shall not use profanity, make negative/offensive gestures, or act in a hostile, harassing, or threatening manner. The Mayor or her designee has the authority to instruct any person conducting themselves in such manner to leave the meeting. Failure to promptly comply may result in law enforcement escorting the person from the property. (Texas Penal Code 42.05 Disrupting Meeting or Procession. (a) A person commits an offense if, with intent to prevent or disrupt a lawful meeting, procession, or gathering, the person obstructs or interferes with the meeting, procession, or gathering by physical action or verbal utterance; (b) an offense under this section is a Class B Misdemeanor). CONSENT AGENDA (All items on the Consent Agenda are routine and may be approved with one motion and vote; however, should any member of the Council wish to discuss an item, said item may be removed from the Consent Agenda by request of a Councilmember prior to the motion being made.) Approval of an ordinance of the City Council of the City of Balch Springs, Texas approving the 2026 annual update to the service and assessment plan and assessment roll for the Balch Springs Public Improvement District No. 1 including the collection of the 2026 annual installments. B. Consideration and action regarding approval of a Request for Qualification (RFQ) 2026- 00-02 to Dunaway to enter into contract negotiations for right-of-way agent and easement acquisition services in support of the City of Balch Springs Southeast Trail Phase 1A project. C. Consideration and action regarding approval of Request for Proposal (RFP) 2026-00-01 (CSJ 0095-13-050) to Central North Construction, LLC and to enter into contract negotiations for construction and install of landscaping improvements to the Balch Springs/TXDOT Green Ribbon Project located at IH-20 at Seagoville Road and Beltline. D. Consideration and action of authorizing the City Manager to negotiate and execute the Development Agreement with BWI Contractors LLC to develop and acquire land located at 2400 Lora Lane, 2404 Lora Lane, 2408 Lora Lane, 2416 Lora Lane, 2502 Lora Lane, 11524 Lockport Drive, 315 Lakeside Road, and 732 Lakeside Drive for development of single-family residential homes and one (1) duplex at 2815 Nan Jones Avenue, one (1) multifamily property at 4417 Pioneer Road. E. Consideration and action regarding a contract amendment in the amount of $40,450 with Freese & Nichols regarding engineering and design services for the 2024 Street Maintenance Tax (SMT) not to exceed $847,443. INDIVIDUAL ITEMS 1. Consideration and action on setting a Public Hearing date for August 24, 2026, and City Council to take a record vote on the Proposed Tax Rate for 2026-2027. 2. Update regarding bulk services from Frontier Waste Solutions.
